1. Introduction
Solar Scout AU (“Solar Scout AU”, “we”, “us”, “our”) operates the website located at solarscoutau.com (the “Website”) and associated lead-matching services (together, the “Services”). Solar Scout AU is a trading name of an Australian proprietary limited company registered in New South Wales.
Solar Scout AU is committed to handling personal information in accordance with the Privacy Act 1988 (Cth) (the “Privacy Act”) and the Australian Privacy Principles (“APPs”) contained in that Act.
This Privacy Policy explains how Solar Scout AU collects, holds, uses, discloses, secures and otherwise handles personal information, and how individuals may access or correct that information, request its deletion, or make a complaint about our handling of it.
By accessing the Website, completing any quiz, eligibility check, calculator, lead form, or other interactive funnel on the Website, or otherwise providing personal information to Solar Scout AU, you confirm that you have read, understood and consented to the collection, use and disclosure of your personal information as set out in this Privacy Policy.
2. What Personal Information We Collect
Solar Scout AU primarily collects personal information directly from you when you engage with our multi-step quiz funnel, eligibility check, lead form or other tools on the Website. The categories of personal information we typically collect include:
- Identity information: your full name and, where provided, your title or salutation;
- Contact information: your residential address (including street number, suburb, state and postcode), email address and telephone or mobile number;
- Property and energy information: information about your home, including property type, ownership status, roof type and condition, household occupancy, and information drawn from your electricity bill such as your retailer, average quarterly spend, average daily usage, peak/off-peak usage patterns and meter type;
- Eligibility indicators: answers to questions designed to indicate eligibility for government solar incentives, rebates or finance products;
- Technical information: IP address, device type, browser type, operating system, referring URL, pages viewed, click and scroll behaviour, and similar information automatically collected via cookies, pixels, tags and analytics tools (including third-party analytics and advertising platforms);
- Communications: the content of any correspondence you send to us, including via the email address save@solarscoutau.com.
You are not legally obliged to provide personal information to Solar Scout AU. However, if you do not provide the information requested in the quiz funnel or lead form, we will not be able to assess potential eligibility or match you with relevant solar retail partners.
3. How We Collect Personal Information
Personal information is collected:
- directly from you when you complete any field, quiz step or form on the Website;
- automatically through cookies, tags, pixels and similar tracking technologies when you visit the Website;
- via third-party advertising and analytics platforms, including but not limited to Meta (Facebook/Instagram), Google and TikTok, in respect of campaigns that direct you to the Website;
- via the third-party lead-capture and funnel platform that hosts our quiz infrastructure; and
- from our internal sales team or third-party solar retail partners where, for example, they update us on the status of a follow-up call.
4. Purposes for Which We Collect, Hold, Use and Disclose Your Information
Solar Scout AU collects, holds, uses and discloses personal information for the following primary purposes:
(a) to operate the Website and the eligibility quiz funnel, including to assess indicative eligibility for solar incentives, rebates, finance products or solar product offers;
(b) to match you with one or more solar retail partners or installers in our network;
(c) to enable Solar Scout AU’s in-house sales and appointment-setting team to contact you by telephone, SMS, email or other electronic means to qualify your interest, set appointments and discuss solar and battery product offers;
(d) to sell, transfer or otherwise distribute lead data to independent third-party solar retailers, installers and financiers within our network, including (without limitation) partners servicing the Newcastle, Brisbane and Adelaide markets, so that those partners may contact you directly regarding solar and battery products and related offers;
(e) to send you direct marketing communications regarding solar, battery, energy efficiency, finance and related products and services, by telephone (including calls to numbers listed on the Do Not Call Register, in reliance on your express consent below), SMS, email and other electronic means;
(f) for analytics, conversion tracking, audience building and advertising optimisation, including the creation of custom and lookalike audiences on third-party advertising platforms;
(g) to maintain records, manage our business, train staff, and improve our Services;
(h) to comply with our legal obligations, respond to lawful requests from regulators or law enforcement, and to establish, exercise or defend legal claims.
5. Referral Fees and Commercial Arrangements
You acknowledge that Solar Scout AU may receive a referral fee, commission, lead-purchase fee or other commercial consideration from third-party solar retail partners, installers and finance providers in connection with the supply or referral of your information to them. This commercial arrangement is the basis on which the Services are provided to you at no monetary cost. The receipt of any such fee does not constitute a recommendation or endorsement of any particular partner, and you should make your own enquiries and obtain independent advice before entering into any contract with a third party.
6. Express Consent to Direct Marketing — Spam Act and Do Not Call Register
By submitting any quiz, eligibility check or lead form on the Website, and (where presented at the point of submission) by ticking the relevant consent option, you provide your express, informed and unambiguous consent to receive direct marketing communications, including telephone calls, SMS messages, MMS messages, emails and other electronic messages, from each of the following:
(a) Solar Scout AU and its in-house sales and appointment-setting team; and
(b) Solar Scout AU’s network of independent third-party solar retail partners, installers, finance providers and related service providers, to whom your lead data may be supplied for the purpose of contacting you regarding solar, battery, energy efficiency, finance and related products and services.
This consent is provided for the purposes of:
- section 16 of the Spam Act 2003 (Cth), authorising the sending of commercial electronic messages to you by Solar Scout AU and the third-party partners described above;
- section 11 of the Do Not Call Register Act 2006 (Cth), authorising telemarketing calls to be made to any telephone number you provide, including any number registered on the Do Not Call Register; and
- APP 7, authorising the use and disclosure of your personal information for direct marketing.
You acknowledge that this consent will remain in force until you withdraw it. You may withdraw your consent or opt out of direct marketing at any time, without charge, by:
- replying “STOP” to any SMS;
- using the unsubscribe link in any marketing email;
- requesting during any call that the caller place you on their internal do-not-call list; or
- emailing save@solarscoutau.com with the words “Opt Out” in the subject line.
Withdrawal of consent will take effect within a reasonable period and may not, due to processing timelines, prevent communications that were already in the queue at the time of your request. Withdrawal of consent in respect of Solar Scout AU does not automatically withdraw consent in respect of third-party partners to whom your data has already been supplied; you may need to contact those partners separately, or email save@solarscoutau.com requesting that we pass on your opt-out request.
7. Disclosure of Personal Information
In addition to the disclosures described above, Solar Scout AU may disclose personal information to:
- our service providers, including hosting providers, lead-capture and funnel platforms, CRM providers, telephony and SMS providers, email service providers, analytics providers, and advertising platforms;
- our professional advisers, including lawyers, accountants and auditors;
- any person to whom disclosure is required or authorised by law, including law enforcement, regulators (including the Office of the Australian Information Commissioner (“OAIC”)), and courts;
- any acquirer or proposed acquirer of all or part of our business or assets.
8. Overseas Disclosure
Some of our service providers — including hosting, analytics and advertising platforms operated by Meta Platforms Inc., Google LLC, and similar providers — store or process personal information in the United States, the European Union, the Philippines, and other jurisdictions outside Australia. The privacy laws of those jurisdictions may not provide an equivalent level of protection to the Privacy Act.
By submitting your information, you give your informed consent under APP 8.2(b) to the disclosure of your personal information to those overseas recipients for the purposes set out in this Privacy Policy, and you acknowledge that, by giving this consent, APP 8.1 will not apply and Solar Scout AU will not be required to take reasonable steps to ensure those overseas recipients comply with the APPs.
9. Sensitive Information
Solar Scout AU does not seek to collect sensitive information (as defined in the Privacy Act) through the Website. You should not submit sensitive information through the quiz funnel or any form on the Website. Where any question on the Website touches on government concession or pensioner eligibility, you provide your express consent under APP 3.3(a)(i) to the collection of that information for the purposes of assessing indicative eligibility and matching you with relevant partners.
10. Cookies and Tracking Technologies
The Website uses cookies, pixels (including the Meta Pixel and Google tags), tags, web beacons, session recording tools and similar technologies to collect information about your interactions with the Website and to support analytics, advertising, retargeting and conversion measurement. You can disable cookies via your browser settings, but doing so may affect the functionality of the Website.
11. Automated Processing
The Website uses automated processes to assess indicative eligibility based on the information you submit. These assessments are indicative only and do not constitute a decision that significantly affects you. Any final decision regarding the supply of solar products, finance, or rebate eligibility is made by the relevant third-party retailer, installer, financier or government scheme administrator.
12. Data Security
Solar Scout AU takes reasonable steps to protect the personal information we hold from misuse, interference, loss, unauthorised access, modification and disclosure. These steps include access controls, encryption in transit, and contractual obligations on our service providers. No method of transmission over the internet, however, is entirely secure, and we cannot guarantee absolute security.
13. Data Breach Notification
Where Solar Scout AU becomes aware of a data breach involving personal information that is likely to result in serious harm to any individual, we will assess the breach and, where required under the Notifiable Data Breaches scheme in Part IIIC of the Privacy Act, notify affected individuals and the Office of the Australian Information Commissioner as soon as practicable.
14. Data Retention and Routine Purging
Solar Scout AU retains personal information only for as long as is reasonably necessary for the purposes set out in this Privacy Policy, or as required by law. Consistent with the principle of data minimisation, user activity logs and certain lead records are routinely scrubbed and purged from our active online servers on a periodic basis. Following such purging, residual copies may continue to exist in encrypted backups, archived systems, or in the systems of third-party partners to whom your information has already been disclosed, until those copies are overwritten or deleted in the ordinary course.
15. Children
The Website and Services are not directed to persons under 18 years of age. Solar Scout AU does not knowingly collect personal information from minors. If we become aware that we have collected personal information from a person under 18, we will take reasonable steps to delete that information.
16. Access, Correction and Deletion
You have the right under the Privacy Act to request access to, and correction of, the personal information Solar Scout AU holds about you.
You may also request that Solar Scout AU delete the personal information we hold about you. While the Privacy Act does not provide a general statutory right to deletion in all circumstances, Solar Scout AU will, on receipt of a verified request, take reasonable steps to delete or de-identify your personal information from our active systems, subject to:
(a) any legal obligation we have to retain the information;
(b) the technical limits of removing information from backups, archives and logs (which will be addressed in the ordinary course of overwriting); and
(c) the fact that personal information already supplied to third-party partners must be addressed by those partners directly, although Solar Scout AU will, on request, pass on a deletion or opt-out request to partners to whom your data was supplied where reasonably practicable.
To make an access, correction or deletion request, please email save@solarscoutau.com with the subject line “Privacy Request — Access”, “Privacy Request — Correction” or “Privacy Request — Deletion”, as applicable. We may require you to verify your identity before actioning the request, and we will respond within a reasonable period and in any event within 30 days.
There is no fee for making a request, although we may charge a reasonable fee for providing access in unusually resource-intensive cases.
17. Complaints
If you believe Solar Scout AU has handled your personal information in a manner that breaches the Privacy Act or the APPs, you may lodge a complaint with us by emailing save@solarscoutau.com with the subject line “Privacy Complaint”. Please include sufficient detail to allow us to investigate, including the nature of the concern, the personal information involved, and how you would like the matter resolved.
We will acknowledge your complaint within a reasonable period and aim to provide a substantive response within 30 days.
