1. Acceptance of These Terms
These Terms of Use (the “Terms”) govern your access to and use of the website located at solarscoutau.com (the “Website”) and any associated tools, calculators, eligibility checks, quizzes, lead forms, content and services made available through the Website (together, the “Services”), each operated by Solar Scout AU (“Solar Scout AU”, “we”, “us”, “our”). Solar Scout AU is a trading name of an Australian proprietary limited company registered in New South Wales.
By accessing or using the Website or the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not access or use the Website or the Services.
2. Nature of the Services — Lead-Matching Only
You acknowledge and agree that:
(a) Solar Scout AU operates the Website strictly as a consumer-facing lead-matching and information platform. Solar Scout AU does not sell solar panels, batteries, inverters or any other solar or energy product, does not perform site assessments or installations, does not extend credit or finance, does not take payments through the Website, and does not provide financial product advice, credit assistance, energy advice, tax advice or legal advice;
(b) the Services consist of (i) the provision of general information about solar, battery and energy products and incentives, (ii) the operation of an eligibility quiz funnel that captures information you voluntarily submit, and (iii) the matching and distribution of that information to Solar Scout AU’s in-house sales and appointment-setting team and to independent third-party solar retail partners, installers and finance providers;
(c) any contract for the supply of solar products, batteries, installation services, finance, or any related product or service will be between you and the relevant third-party retailer, installer or finance provider, and not with Solar Scout AU. Solar Scout AU is not a party to, and has no liability under, any such contract; and
(d) Solar Scout AU may receive a referral fee, commission or other commercial consideration from third-party partners in connection with the supply or referral of your information to them, which is the basis on which the Services are provided to you at no monetary cost.
3. General Information and Illustrative Purposes Only
You expressly acknowledge and agree that all content on the Website — including without limitation all text, headlines, marketing copy, hook statements (including but not limited to “Check Your Eligibility For Government Solar Incentives”, “No-Net-Cost Solar”, and any similar phrase), tools, quizzes, eligibility checks, calculators, ROI estimates, savings estimates, payback period estimates, bill reduction estimates, rebate estimates, finance estimates, and any output generated by any interactive feature — is provided for GENERAL INFORMATION AND ILLUSTRATIVE PURPOSES ONLY.
Without limiting the generality of the foregoing:
(a) No guarantee of eligibility: Solar Scout AU does not guarantee, represent or warrant that you will qualify for, be approved for, or receive any government solar rebate, incentive, certificate (including small-scale technology certificates or state-based equivalents), grant, loan, subsidy, or any other form of financial benefit. Eligibility for any such program is determined solely by the relevant government authority or scheme administrator and is subject to criteria, conditions, caps and timing that may change without notice;
(b) No guarantee of “No-Net-Cost” outcomes: any reference on the Website to “no-net-cost solar”, “free solar”, “$0 upfront”, “government-funded solar” or any similar phrase is a generalised marketing reference to the combined effect of available rebates, certificates and finance products that may, in some circumstances, reduce a customer’s net upfront and/or ongoing cost. Such phrases are not a representation that any particular customer will achieve a zero net cost outcome, and individual outcomes will vary materially based on system size, property, household consumption, retailer, finance terms, prevailing certificate prices, and changes in law or policy. Where such phrases appear on the Website, they are accompanied by, or immediately link to, qualifying information explaining the assumptions, conditions and eligibility criteria on which the phrase is based;
(c) No guarantee of savings or return on investment: any savings estimate, ROI figure, payback period, bill-reduction figure or similar output is indicative only, is generated using generalised assumptions, and is not a forecast or representation of the actual savings or return any individual customer will achieve;
(d) No professional advice: nothing on the Website constitutes financial product advice, credit assistance, taxation advice, energy advice, engineering advice or legal advice. The Services do not take into account your personal objectives, financial situation or needs. You must obtain your own independent professional assessment, including from a licensed electrician, accredited solar retailer, qualified financial adviser and/or tax adviser as relevant, before making any decision in relation to solar, battery or finance products.
You acknowledge that you rely on any information on the Website at your own risk.
4. Your Submissions and Express Consent to Contact
By submitting any information through the Website (including via any quiz, eligibility check, lead form, or contact form), you:
(a) warrant that the information you submit is true, accurate, current and complete, that you are at least 18 years of age, and that you are the account holder or an authorised occupant of the address you submit;
(b) consent to the collection, use and disclosure of your information as set out in our Privacy Policy, including its distribution to Solar Scout AU’s in-house sales team and to Solar Scout AU’s network of independent third-party solar retail partners, installers and finance providers;
(c) provide your express consent to receive marketing telephone calls (including to numbers listed on the Do Not Call Register), SMS, MMS, emails and other electronic messages from Solar Scout AU and Solar Scout AU’s network of independent third-party solar retail partners, installers and finance providers, in accordance with section 6 of our Privacy Policy and for the purposes of section 11 of the Do Not Call Register Act 2006 (Cth) and section 16 of the Spam Act 2003 (Cth); and
(d) acknowledge that Solar Scout AU may receive a referral fee or other commercial consideration in connection with the supply of your information to such partners.
5. Acceptable Use
You must not, and must not attempt to:
(a) use the Website or Services for any unlawful, fraudulent or misleading purpose;
(b) submit information about any person other than yourself without that person’s express prior authorisation;
(c) interfere with, disrupt, reverse engineer, scrape, data-mine, or attempt to gain unauthorised access to the Website, its underlying infrastructure, or any related systems;
(d) introduce any virus, malware, or other harmful code;
(e) use the Website or Services in any way that violates any applicable law, including the Australian Consumer Law, the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth), or the Do Not Call Register Act 2006 (Cth).
6. Intellectual Property
All content on the Website, including text, graphics, logos, images, software, designs and the “Solar Scout AU” brand, is owned by or licensed to Solar Scout AU and is protected by Australian and international intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable licence to access and view the Website for your personal, non-commercial use only. All other rights are reserved.
7. Third-Party Content and Links
The Website may contain links to, or content from, third parties, including third-party solar retail partners. Solar Scout AU does not endorse, and is not responsible for, any third-party content, websites, products or services, and provides such links solely as a convenience.
8. Disclaimers and Limitation of Liability
(a) Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition implied or imposed by, the Australian Consumer Law, Schedule 2 to the Competition and Consumer Act 2010 (Cth) (the “ACL”), or any other applicable law that cannot lawfully be excluded, restricted or modified.
(b) Subject to clause 8(a), and to the maximum extent permitted by law:
(i) the Website and Services are provided on an “as is” and “as available” basis, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, currency, non-infringement, or uninterrupted or error-free operation;
(ii) Solar Scout AU excludes all liability for any indirect, special, consequential, incidental or punitive damages, or any loss of profits, loss of revenue, loss of business opportunity, loss of data, or loss of goodwill, suffered or incurred by you in connection with your use of the Website or Services, or in connection with any product, service, conduct, representation, advice, installation, performance, warranty or contract of any third-party solar retailer, installer or finance provider to whom your information has been supplied; and
(iii) Solar Scout AU’s total aggregate liability to you for all claims arising out of or in connection with the Website, the Services or these Terms, however arising (whether in contract, tort (including negligence), under statute or otherwise), is limited, at our election, to the resupply of the Services or AUD $500, whichever is lower.
(c) Where Solar Scout AU is liable under a consumer guarantee under the ACL in respect of services that are not of a kind ordinarily acquired for personal, domestic or household use or consumption, our liability is limited, to the extent permitted by section 64A of the ACL, at our election to the supplying of the Services again or the payment of the cost of having the Services supplied again.
9. Indemnity
To the maximum extent permitted by law, you indemnify and hold harmless Solar Scout AU from and against all claims, liabilities, losses, damages, costs and expenses (including reasonable legal costs) arising from or in connection with:
(a) your breach of these Terms or our Privacy Policy;
(b) your submission of any information that is false, inaccurate, misleading or that you were not authorised to submit;
(c) your use of, or reliance on, any content on the Website or any output of any quiz, calculator or tool; and
(d) any dispute between you and any third-party solar retail partner, installer or finance provider.
10. Suspension and Termination
Solar Scout AU may suspend, restrict or terminate your access to the Website or the Services, in whole or in part, at any time and without notice, including where we reasonably suspect a breach of these Terms or any applicable law.
11. Severability
If any provision of these Terms is held to be invalid, illegal or unenforceable, it will be severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
12. No Waiver
A failure or delay by Solar Scout AU in exercising any right under these Terms does not operate as a waiver of that right.
13. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Solar Scout AU in respect of your use of the Website and the Services, and supersede any prior agreement, representation or understanding.
14. Governing Law and Jurisdiction
These Terms are governed by, and are to be construed in accordance with, the laws of the State of New South Wales, Australia. You and Solar Scout AU submit to the exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them in respect of any dispute arising under or in connection with these Terms.
